On October 10, 2024, Edible Garden AG Incorporated (the "Company") issued a press release announcing that it received a letter from the Listing Qualifications Department of the Nasdaq Stock Market LLC ("Nasdaq") on October 9, 2024 indicating that, based on the Company's Form 8-K filed with the Securities and Exchange Commission on October 4, 2024, the Company had regained compliance with the minimum stockholders' equity requirement for continued listing on Nasdaq under Listing Rule 5550(b)(1). A copy of the press release is filed as Exhibit 99.1 to this Current Report on Form 8-K. Nasdaq will continue to monitor the Company's ongoing compliance and, if upon filing its next periodic report the Company does not evidence compliance with the stockholders' equity requirement, the Company's securities may be subject to delisting.
