(collectively, the " Company "), filed a verified petition and complaint pursuant to Article 78 of the New York Civil Practice Law and Rules against the New York State Department of Environmental Conservation (the " Department ") in New York Supreme Court, Yates County (the " Court "), seeking declaratory and injunctive relief relating to the Department's denial of the Company's Title V Air Permit renewal application for the Dresden, NY facility (the " Facility "). On August 20, 2024, the Company submitted a motion to the Court by Order to Show Cause seeking a temporary restraining order and preliminary injunction (the " TRO Request ") permitting the Facility to continue operations during the pendency of the Article 78 proceeding. The Company expects that a decision on the TRO Request will be forthcoming in the days to come and will continue to provide updates on the Article 78 proceeding as necessary and appropriate.
